This case concerns an application to the Adoption Authority of Ireland (AAI) to register the American domestic Stepparent adoption of children born through surrogacy in the USA on the Register of Intercountry Adoptions in Ireland (RICA). The issues before the Court were whether the Adoptions in question offended certain aspects of Irish Adoption legislation. The specific matters which the Court had to consider were the payments made under the surrogacy arrangement and the consents given by the egg donor and the surrogate in the context of the subsequent adoption of the children by the non-biological father. The court found that the payments which were made were as part of the surrogacy arrangement and were not payments for the adoptions.
